1. Scope

This addendum applies to all End User Content uploaded to VPQ that features individuals under the age of 18 ("minor athletes"). It supplements the VPQ Terms of Service, Community Guidelines, and the Company's Privacy Policy, currently available at www.vpq.app/privacy-policy.

In the event of a conflict between this addendum and the Terms of Service, the Terms of Service control. All terms not defined in this addendum have the meanings given in the Terms of Service.

2. Uploader Responsibility and Content Standards

All uploaders must be registered End Users with an End User Account and must be at least 16 years old under the Terms of Service. Content uploaded by an End User may feature minor athletes under 18, who are protected under this Policy even though they are not the uploader or account holder.

2.1 Public Event Content

VPQ is designed for sharing sports content captured at public or semi-public events, including games, tournaments, practices open to observers, and similar athletic activities. When minor athletes appear incidentally in End User Content captured at these events – as players, participants, or attendees – no individual authorization from each minor athlete's parent or guardian is required, provided the content is captured and shared in good faith and in a manner consistent with these guidelines.

By uploading End User Content to VPQ, each End User represents that the End User Content was captured in a setting where filming was reasonably expected by participants and attendees.

2.2 Content an End User Is Permitted to Upload

A registered End User with an End User Account who is at least 16 years old may upload End User Content featuring minor athletes if:

• the End User Content was captured at a public or semi-public sporting event, practice, or related athletic activity where filming is customary and visible;

• the End User Content depicts minor athletes in the context of athletic participation (e.g., gameplay, warm-ups, celebrations, team activities) and does not focus on any minor athlete in a manner unrelated to their athletic participation; or

• the End User is a parent, guardian, coach, team official, or event organizer uploading End User Content from an event the End User attended or organized in that capacity.

2.3 Content Standards for Minor Athletes

Regardless of the setting, all End User Content featuring minor athletes must:

• depict minor athletes only in the context of their athletic participation or event attendance;

• not include content that is sexually suggestive, demeaning, or that places a minor athlete in an unflattering or harmful context;

• not include personally identifying information about a minor athlete beyond what is visible in the footage itself (e.g., name on a jersey, team affiliation);

• comply with all applicable laws, including those governing the recording and distribution of End User Content involving minor athletes.

2.4 Removal Requests

VPQ respects the rights of parents and guardians. Any parent or legal guardian of a minor athlete appearing in End User Content may submit a removal request to vpq@vpq.app. VPQ will review and process valid removal requests. Removal requests will be honored where the content does not meet the standards in Section 2.3, or at VPQ's discretion when a parent or guardian objects to their child's appearance in a specific upload.

2.5 End User Responsibility

Each End User is responsible for ensuring that the End User Content it uploads complies with these guidelines and all applicable laws. If an End User's upload is the subject of a valid removal request or legal claim arising from the End User's failure to comply with these guidelines, the End User may be held responsible for resulting damages. VPQ reserves the right to remove any End User Content at its discretion.

3. Athlete Likeness Rights

Minor athletes and their families retain all rights to their name, image, and likeness ("NIL rights") as provided by applicable state and federal law. The license granted to Company in the Terms of Service does not transfer or diminish these rights.

End Users must respect the NIL rights of all minor athletes featured in their End User Content. Uploading End User Content to VPQ does not grant the End User any commercial rights to the name, image, or likeness of any minor athlete depicted in that End User Content.

VPQ acknowledges that the landscape of athlete NIL rights, particularly for minor athletes, continues to evolve. We will update this policy as needed to reflect changes in applicable law.

4. Commercial Use Restrictions

End User Content may not be commercially redistributed, licensed, or sold by any third party without the express written consent of the original End User uploader.

For End User Content featuring minor athletes, any third-party commercial redistribution additionally requires the written consent of the minor athlete's parent or legal guardian.

Company's use of End User Content, including for product development and the creation of de-identified or aggregated data, is governed by the license grant and other applicable provisions of the Terms of Service and the Privacy Policy.

5. Content Removal Requests

Parents, guardians, or minor athletes (upon reaching the age of majority) may request removal of End User Content featuring the minor athlete by contacting vpq@vpq.app with the subject line "Minor Content Removal Request."

What to Include in Your Request

• A link to or description of the content

• Your relationship to the minor athlete (parent, guardian, or the individual upon reaching age of majority)

• Contact information for follow-up

Response time: VPQ will process removal requests within 30 days of receipt.

6. Content Standards for Minor Athletes

All content featuring minor athletes is subject to the full VPQ Community Guidelines. In particular:

• Content that sexualizes, exploits, or endangers minor athletes in any way is subject to the zero-tolerance policy and will result in an immediate permanent ban and a report to the National Center for Missing & Exploited Children (NCMEC).

• Content depicting minor athletes in unsafe or inappropriate situations will be removed.

• Tags, labels, and descriptions applied to content featuring minor athletes must be appropriate for all ages.

7. Contact Information

This addendum may be updated from time to time. We will notify users of material changes through the platform. Continued use of VPQ after changes are posted constitutes acceptance of the updated addendum.
